ZipRx LLC Terms of Service
These Terms govern your access to and use of the ZipRx mobile application, website, and prescription delivery services.
Introduction
Welcome to ZipRx LLC (“ZipRx,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the ZipRx mobile application, website, and prescription delivery services collectively referred to as the “Services.”
By creating an account, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Description of Services
ZipRx provides technology-enabled prescription delivery services by coordinating with licensed pharmacies and delivering prescription medications to eligible patients.
Deliveries may be performed by ZipRx employees and/or authorized independent contractors.
ZipRx is not a pharmacy, does not prescribe medications, and does not provide medical advice.
2. Eligibility
- You must be legally authorized to receive prescription medications.
- You must provide accurate and complete account information.
- You must comply with all applicable federal, state, and local laws.
If ordering on behalf of another individual, you represent that you are legally authorized to do so.
3. Prescription Orders
Prescription fulfillment is solely the responsibility of the dispensing pharmacy.
ZipRx coordinates pickup and delivery but does not verify prescriptions, dispense medications, compound medications, label medications, perform pharmacist counseling, or make clinical decisions.
4. Pharmacy Responsibility
Participating pharmacies are solely responsible for verifying prescriptions, drug utilization review, dispensing the correct medication, proper labeling, pharmacist counseling, and clinical decisions.
Except to the extent caused by ZipRx’s own negligence, willful misconduct, or violation of applicable law, ZipRx is not responsible for medication errors, dispensing errors, labeling errors, prescription inaccuracies, pharmacy inventory issues, or clinical decisions made by pharmacies or healthcare providers.
If you believe you have received the wrong medication, do not take it. Contact the dispensing pharmacy immediately. In the event of a medical emergency, call 911 or seek emergency medical care.
5. Payment
Payments are securely processed through Stripe.
The dispensing pharmacy determines the cost of prescription medications.
To facilitate prompt prescription fulfillment, ZipRx may advance payment to the pharmacy on your behalf. By placing an order, you authorize ZipRx to charge your selected payment method for prescription costs, delivery fees, applicable taxes, and other disclosed charges.
6. Delivery
Delivery availability varies by location.
Estimated delivery times are estimates only and are not guaranteed.
ZipRx reserves the right to refuse, postpone, or cancel deliveries when required by law or when necessary for safety or operational reasons.
7. Controlled Substances
Where permitted by law, controlled substances may only be delivered:
- To the patient named on the prescription or another individual legally authorized to receive the medication.
- After verification of a valid government-issued photo ID when required.
- Within the same state in which the prescription was dispensed unless otherwise permitted by applicable law.
ZipRx reserves the right to refuse delivery if legal requirements cannot be satisfied.
8. Identity Verification
Certain deliveries require government-issued photo identification.
Recipients may be required to present identification before medications are released.
Failure to provide acceptable identification may result in cancellation of the delivery or return of the prescription to the pharmacy.
9. Cancellations and Refunds
Orders may be cancelled only before medications have been picked up from the dispensing pharmacy. Full refunds may be issued only if cancellation occurs before pickup.
After medications have been picked up, cancellations and refunds are generally unavailable except where required by applicable law.
10. Medication Handling
ZipRx uses reasonable care when transporting medications.
Prescription deliveries may utilize tamper-evident prescription bags, security seals, and lockable transport containers or bags when appropriate.
Unless expressly offered, ZipRx does not guarantee temperature-controlled transportation. Customers should immediately refrigerate medications when instructed by the dispensing pharmacy.
11. Inspection Upon Delivery
Recipients should inspect all medications immediately upon delivery.
If packaging appears damaged or tampered with, or if you believe the incorrect medication has been delivered, do not use the medication. Contact both the dispensing pharmacy and ZipRx immediately.
12. Recipient Availability
Certain deliveries require an authorized recipient.
If no authorized recipient is available or required identification cannot be verified, ZipRx may return the prescription to the pharmacy.
Additional delivery fees may apply where permitted by law.
13. Prescription Returns
Undeliverable prescriptions may be returned to the dispensing pharmacy in accordance with applicable law.
Certain medications, including controlled substances and temperature-sensitive medications, may not be eligible for redelivery.
14. Delivery Delays
Delivery delays may occur due to pharmacy processing, prescription verification, weather, traffic, road closures, technology failures, staffing shortages, or other circumstances beyond ZipRx’s reasonable control.
ZipRx is not responsible for delays resulting from these circumstances except as required by law.
15. No Medical Advice
ZipRx provides delivery and technology services only.
ZipRx does not provide medical, pharmaceutical, nursing, or legal advice.
Questions regarding medications should be directed to the prescribing provider or dispensing pharmacy.
16. Insurance
Insurance claims are processed by the dispensing pharmacy.
ZipRx does not guarantee insurance coverage, copay amounts, deductibles, reimbursement, or formulary eligibility.
Customers remain responsible for charges not paid by insurance.
17. Payment Authorization and Chargebacks
By placing an order, you authorize ZipRx to charge your selected payment method.
If ZipRx advances payment to the pharmacy, you remain responsible for reimbursing ZipRx.
Fraudulent or improper chargebacks may result in account suspension and collection efforts where permitted by law.
18. Driver Safety
ZipRx prioritizes the safety of its employees and contractors.
Delivery personnel may refuse or discontinue a delivery if they reasonably believe conditions are unsafe.
19. Delivery Records
ZipRx may maintain records relating to deliveries, including delivery confirmation, date and time of delivery, recipient signature when required, identity verification confirmation, GPS delivery location, delivery notes, and photographs where permitted by law.
These records help with compliance, quality assurance, security, and dispute resolution.
20. Refusal of Service
ZipRx reserves the right to refuse or discontinue Services in order to comply with applicable law, protect patient safety, protect employees and contractors, prevent fraud or abuse, address suspected criminal activity, or respond to unsafe delivery conditions.
21. Force Majeure
ZipRx shall not be liable for delays or failures caused by events beyond its reasonable control, including severe weather, natural disasters, public health emergencies, labor disputes, governmental actions, utility failures, cyberattacks, transportation disruptions, or similar events.
22. Electronic Communications
By using the Services, you consent to receive electronic communications from ZipRx, including account notices, delivery updates, receipts, security alerts, and legal notices.
23. Account Suspension
ZipRx may suspend or terminate accounts that violate these Terms, engage in fraud, misuse the Services, fail to pay valid charges, or pose a risk to ZipRx, participating pharmacies, delivery personnel, or other users.
24. Limitation of Liability
To the fullest extent permitted by law, ZipRx shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the Services.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
25. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles, except where federal law applies.
26. Changes to These Terms
ZipRx may update these Terms from time to time.
Updated Terms become effective upon posting with a revised Effective Date.
Continued use of the Services constitutes acceptance of the updated Terms.
